A 69-year-old Fremont woman was arrested Tuesday night after refusing to end her public comments during a City Council meeting.
The incident came during discussion over a controversial housing development proposed for the east edge of Fremont. Linda Berner refused to step down from the podium after her allotted 3-minute comment time had passed, according to the Fremont Police Department.
City Council rules give members of the general public 3 minutes to speak about each agenda item, with 5 minutes granted to applicants themselves.
Berner was first asked by Mayor Scott Getzschman to wrap up her comments after she had been speaking for approximately 3 minutes and 20 seconds. After Getzschman asked Berner to conclude her comments three more times, Fremont Police Chief Jeff Elliott approached her and asked her to step aside or she would be placed under arrest.
“OK, place me under arrest,” she responded.
So he did, citing her on suspicion of second-degree trespassing.
