A 25-year-old Lincoln man is charged with statutory rape after seeking paternity and winning joint custody of a child born four years ago to a 15-year-old girl.

Zachary Zysset, 4110 S. 17th St., is out of jail on a $25,000 bond after being arrested Oct. 27 by an Adams County sheriff's deputy on a warrant for first-degree sexual assault of a minor.

Investigators say a 20-year-old woman reported earlier this year that she and Zysset had sex several times in Kenesaw during a three-month span in 2012, according to an affidavit for his arrest.

She was 15 when she got pregnant; Zysset was 20 at the time and lived in Kenesaw, the affidavit says.

Under Nebraska law, children younger than 16 cannot consent to sex.

In November that year, the girl gave birth to a baby girl, the affidavit says.

Last year, Zysset sought a court order establishing paternity, and in February, he won joint custody of the child.

Adams County began investigating in September after being contacted by an investigator with the Buffalo County Sheriff's office who had been in contact with the woman, the affidavit said.

Adams County prosecutors charged him Oct. 25 and were granted a warrant for his arrest.

Zysset's attorney, Sean Reagan of Lincoln, declined to comment.

If convicted of the charge, Zysset would face a minimum of one year in prison.
