A Nebraska man has lost his lawsuit accusing officers of the Nebraska State Patrol, Beatrice Police Department and Gage County Sheriff's Office of excessive force in a 2014 DUI arrest.
Billy O'Keefe, 31, filed the case in U.S. District Court in January 2016, when he was in prison, but failed to update the court with his current address when he was released, according to an order last month.
Senior U.S. District Judge Richard Kopf gave him 20 days to update it. When that didn't happen, he dismissed the case late last week.
O'Keefe had sought $1.7 million, alleging that a Nebraska State Patrol trooper and a Beatrice police officer slammed him to the ground when they arrested him for DUI in Beatrice on March 29, 2014, leaving his jaw fractured in two places and a tooth cracked.
He pleaded guilty to DUI, resisting arrest and misdemeanor assault on an officer with bodily fluids in connection to the stop and was sentenced to prison for 3 years 8 months to 6 years 2 months.
