A proposal to outlaw illegal immigrants is being considered by the Fremont City Council.

Councilman Bob Warner has asked for an ordinance that would outlaw harboring, hiring or renting to illegal immigrants.

The plan drew some support from Fremont residents who spoke out on the measure before the council Tuesday night. The state’s Mexican American Commission said defamatory comments about immigrants were made during the meeting.

Norm Pflanz, an attorney with Nebraska Appleseed Center for Law in the Public Interest said such a law would be unconstitutional and that similar laws have been struck down in federal court.

The council did not vote on the proposal; a second reading on the ordinance is scheduled for July 29th.

" How can a proposal that outlaws doing something illegal be unconstitutional? So does that mean that a company's ability to hire illegals is protected by our constitution? On the other hand if something is already illegal, should we need another law to doubly outlaw it? It seems like it would be better to enforce the law that is being broken in the first place. "

" My head hurts on this one! I don't agree with illegal immigrants as they are breaking the law...but I can't help but feel this is racism. Maybe I think that b/c people at the meeting began throwing insults? Anyway, I think it's funny though that Fremont is known as an illegal haven so it's amusing to think of what will happen to Fremont once they run everyone out of town :) Gee...not like any of the locals will be willing to work the jobs or live in the places the illegals vacate. I have to hand it the majority of illegal immigrants...they are harder working than any true blooded American. Now if only we could get them to start paying into the system....HEY there's an idea maybe we should put our efforts towards making them LEGAL...nope Fremont would never think of that! "

" I believe it's already a law that you need proper documentation to hire a person. That's why the illegals buy paper and steal identities so they can get a job. The employers are only following the law. And how is this proposal "racist". Illegals are any person not here legally. They could be Russian, Porto Rican, Mexican, Canadian. The only one that's racist is the person that immediately thought they're discriminating on a race. "

" I would not say most settlers were "illigal" emergrants. Even hundreds of years ago most countries controlled who could live and once our country got organized it tried to control who came to our country. China and many eastern European countries had restrictions and limits on coming to American. Most of theses were out right "racism", There are none of these placed on people from Mexico. Check on the rules to become a "Mexican" citizen, they are impossible to be done. "

" I know first hand what it means to be a discriminated minority and surprisingly I'm white but just heterosexually challenged. However what gets me about the whole undocumented worker debate (I refuse to call it the illegal immigrant debate because my ancestors came here ILLEGALLY from Sweden back in the Pioneer Days) is the lack of human dignity towards our Latino neighbors and friends. They come here to obtain the American dream so then they can better their lives and their family's life and yet the "un-American" Americans say no because they are of hispanic ancestory. To place how today's societal attitude towards Latinos is comparing them with the Irish back when New York had Ellis Island. Simply put, this is the result of xenophobic biased attitudes all because 'Dora the Explorer' is teaching young white kids Spanish. But go ahead and deny those thoughts and call it something else but that only does a dis-service to your morality. "

" "How can a proposal that outlaws doing something illegal be unconstitutional?" It's unconstitutional under Article VI, Clause 2 of the United States Constitution, commonly known as the Supremacy Clause. For almost 200 years the U.S. Supreme Court has ruled that state and local laws that interfere with federal law are unconstitutional. Only the federal government can regulate immigration and determine who can or can not be in this country legally. The City of Fremont, nor any city or state, can not make these determinations. Think about it for a minute. What if every city in the entire country passed its own immigration law? It would be chaos. Yes, the federal government has failed to pass comprehensive immigration but that does not mean that cities and states can pass their own immigration laws. The solution is to demand comprehensive immigration reform from the federal government. "

I dont care what country they are here from, just do it the right way. "

I don't believe that the Native Americans had any immigration laws on the books. The immigrants from Europe and such killed most of them, took over the country and set up the foundations for life as we know it.

Now, we're allowing a new group of immigrants come in and do a non-hostile takeover. Prepare to learn Spanish or else you won't be able to communicate with half the US population in 20 years. Prepare for all the cultural changes that come along with passively allowing anyone to come across the border with little or no penalty. Also prepare to take care of these people who will pay little into city and county coffers (property tax, for instance) with universal health care and welfare.

These are not racist remarks or opinions. They are stone cold facts. "

Why should I... wrote on July 11, 2008 1:26 pm:
" Why should I have to pay taxes so "illegal" or undocumented immigrants can live in this county, work, not speak the language and expect the same rights that I have. When you pay the taxes, speak the language and stop complaining about how you are descriminated against I will gladly welcome you with open arms. But there is a right way and a wrong way to do it. I feel discriminated against because I have to work to pay taxes to support them...and as far as the whole "this country was founded on illegal immigrants" thing goes that is very inaccurate. Every person that crossed through Ellis Island was documented, given a health check and was never given any type of benefits, such as health care for thier children, subsidized housing or ADC. I work very hard to ensure that all of my "illegal" neighbors can have those wonderful benefits that I as a hard working American Citizen sure don't qualify for. Another difference between "illegal" immigrants today and 100 years ago. Those "illegal" immigrants in 1908 worked all day long then worked all night to learn the language, and didn't expect anything to be given to them! Earning it and expecting it are very different! "

" Does anyone know of an undocumented Latino or Hispanic individual and their families, personally? I do and they are great people who are just as decent as the next average Joe on the street. They want to abide by the rules. In fact, all the ones I talk to want to become legalized American citizens lawfully but the laws and the system aren't user friendly! Most (if not all) undocumented workers that I know of are trying to learn English but it's rather difficult for them to do so. I tried to learn Spanish and German but I had a real hard time to do so. For a person to say that all of "them" are lazy and only want to speak spanish clearly doesn't know a Latino or Hispanic individual personally.

As much as I dislike President Bush, I did agree with him on his stance with on immigration reform. His amnesty proposal was modest and feasible but yet White America (and I'm German by ancestory) said "NO!" But I get sick and tired of how these so called illegal immigrants are the scourge of America. This debate only plays into hard right Republican hands because they can only win on wedge issues during major election cycles. Just like the last two Presidential cycles it was the "homosexual agenda" and now it's illegal immigrants for the hard right. Ultimate irony is that Mike Johanns supported the Bush policy of amnesty then when he quit his job as Ag Sec he changed his tune faster than you can say "Darn Those Illegals!!!" All the while an immigrant worker is suffering just like the rest of us with the rising cost of fuel, food and etc. "

My wife is a LEGAL immigrant. She speaks english. Her native language (Korean) actually has a reversal in the grammer. So when she speaks english, she has to rearrange the words in her head to the order they require in english. Not easy. But she does it. And she does it well.
The point is, people can and DO immigrate here LEGALLY. And they learn to speak the language. As a matter of fact, review the academic performance of the various groups that immigrate to the USA. What you will find is that the Asian countries (Japan, China, Korea, Viet Nam) overwhelmingly outperform the Hispanic immigrants. Why? Because Asian countries have a culture of rigorous academics. Their parents PUSH them to not only learn the language, but to outperform most of the other students. This is NOT the case for the Hispanic culture. It is absolutely NOT academic focused.
Immigrants should be required to come here LEGALLY. If they are here illegally, they should be forced to return to their countries and return through whatever system is in place. My wife did. It wasn't easy. But she is the type of immigrant the all US citizens would appreciate. "
